ORDER
(Order of the Court was made by the Hon'ble Anita Sumanth J.) The Writ Appeal has been filed by the Treasury Commissioner being aggrieved by an order
passed by the Writ Court on 15.03.2023.
2. The Writ Petitioner has filed CMP No.26061 of 2024 seeking to fix an early date for hearing of the Writ Appeal.
3. Learned counsel for the petitioner, had, on the last occasion pleaded that the appellant may settle the retirement benefits as per the computation of the appellant itself, i.e., in accordance with the proceedings of the Pay and Accounts Officer dated 17.06.2015 without prejudice to the outcome of the Writ Appeal.
4. Pending the Writ Appeal, proceedings bearing Na.Ka.No.1803/A1/2023 dated 06.12.2024 have been issued by the concerned authority. The petitioner has filed an objection to the same to the effect that there is a shortfall in the computation to the extent of Rs.3,000/-(approx.). Barring this, and for the moment, the Writ Petitioner is satisfied with proceedings dated 06.12.2024.
5. We record the aforesaid proceedings dated 06.12.2024 and issue a direction to the concerned authority to pay over the amount computed taking note of the objections filed by the Writ Petitioner, within a period of four (4) weeks from today.
