PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent/ District Revenue Officer, Dharmapuri to pass order on the enquiry relating to wrong entry made in UDR patta as survey No.259/1 to an extent of 50 Ares and survey No.259/2 to an extent of 41 Ares at Ungaaranahalli Village, Dharmapuri Taluk & District instead of survey No.259/1 to an extent of 1 acre and survey No.259/2 to an extent of 1.30 1/4 acre at Ungaaranahalli Village, Dharmapuri Taluk & District and rectify the same by considering the settlement deed in doc.No. 1144 of 1955 on the file of the Joint II Sub-Registrar, Dharmapuri dated 02.5.1955 and doc.No.310 of 1982 on the file of the Joint II Sub-Registrar, Dharmapuri dated 16.2.1982.

ORDER

Aggrieved by the fact that the representation made to the respondent on 01.4.2024 by the petitioner and two others for correcting the UDR patta has not been considered and orders passed to date, though an inquiry had been held on 03.9.2024, the petitioner is before this Court.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader accepting notice for the respondent.

3. In the considered view of this Court, though the respondent held an inquiry on 03.9.2024, she failed to pass orders on the said representation dated 01.4.2024. The respondent failed to discharge the statutory duty cast on her.

4. Hence, since an inquiry has already been held by the respondent on 03.9.2024, the writ petition is allowed and the respondent is directed to consider the said representation dated 01.4.2024 submitted by the petitioner and two others and pass appropriate orders thereon within a period of four weeks from the date of receipt of a copy of this order.
