ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.

This Case in Cr.No.304 of 2011 is registered for alleged offences under Sections 294(b), 323, 324 of Indian Penal Code. In this case, though it is submitted that bailable warrant is pending on some of the accused, considering the nature of offence, the background of the parties, the fact that the parties have no objection to the case being disposed of on compromise, and their present position, this is an appropriate Page No.1 of 2 https://www.mhc.tn.gov.in/judis

case for the exercise of jurisdiction under Section 482 of the Code of Criminal Procedure as per Gian Singh -vs- State of Punjab & another, (2012 10 SCC 303). Due to the unique manner in which this dedicated bench conducts hybrid hearings, the filing of written affidavits or terms of compromise is dispensed with.

Accordingly, the proceedings in CC.132/2017 of Judicial Magistrate Court, Gudiyatham, Gudiyatham Taluk, Vellore is quashed and this Suo Motu Transfer Case is disposed of.

08.09.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
