1. This application is filed to condone the delay of 740 days in filing the written statement of the 1st Defendant in CS.No.20 of 2019.

2. This Court heard the learned counsel on either side and perused the affidavit filed in support of this application.

3. Though there is an inordinate delay of 740 days in filing the written statement of the 1st Defendant and no convincing reason has been given for condoning the delay, in order to afford fair opportunity and taking note of the facts that the application for rejection of the plaint filed by the Applicant was dismissed and the appeal preferred as against the same is pending, this Court is inclined to condole the delay and accordingly, the delay is condoned and this application is allowed on payment of a cost of Rs.20,000/- (Rupees twenty thousand only) to the Adyar Cancer Institute, Chennai, on or before 12.02.2024.
