The petitioners/A1 & A2 who apprehend arrest at the hands of the respondent Police for the offences under Sections 406, 420, 506(i) of IPC in Crime No.46 of 2023, seek anticipatory bail.

2. The first petitioner is serving as Head Constable in the Police Department and the second petitioner is wife of the first petitioner. 3.The case of the prosecution is that both the petitioners had conducted an unregistered chit fund for Rs.2,00,000/-. The defacto complainant had also joined in the chit and later, when she sought return of the amount, the petitioners did not repay the amount. It is the further case of the prosecution that in this manner, about 6 persons have been cheated to a total amount of Rs.25,00,000/-.

4.The defacto complainant had also filed an intervening application and it had been stated that hard earned money which he had accumulated in small savings amounting to Rs.2,38,367/- had been taken away by A1 and A2.

5.It is also seen that the first petitioner is working as Head Constable in Police Department bearing No.36388 in Madhavaram Traffic. It 1/4

is also stated that there is also a similar case in STC.No.7237 of 2022 against these petitioners pending before the Fast Track Court I (Magistrate Level), Egmore.

6.It is extremely disheartening to note that a Head Constable who is supposed to protect the interest of the public against perpetrators of crime, is himself accused of an offence, particularly of cheating money from innocent and gullible persons like the intervenor/ defacto complainant and totally had taken away Rs.25,00,000/- In this venture of his, his wife has also joined, which is further disheartening. I am not able to comprehend as to how an anticipatory bail is maintainable and how a serving Head Constable at Madhavaram Traffic Police Station bearing No.36388, has the temerity to file an anticipatory bail application and the respondent, Inspector of Police, St.Thomas Mount Police Station, Alandur has also not taken any steps to secure either one of the two petitioner.

7.In view of the serious nature of the allegations and the offence involved, I am not inclined to grant anticipatory bail. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is also closed.

8.The Inspector of Police, St.Thomas Mount Police Station, Alandur, to be physically present before this Court at 2.15 p.m., on 12.02.2024 to report about taking the petitioner into custody. 9.The Sub Inspector of Police from the said Police Station is present and quite apart from the learned Government Advocate, the Sub Inspector of Police may directly convey this direction to the Inspector of Police.

10.List the matter for reporting compliance at 2.15 p.m., on 12.02.2024.
