O R D E R
The relief sought for in the present writ petition is to direct the respondents to measure and demarcate the boundaries of the petitioner's land situated at Survey No.116/9 in Kandamangalam Village, Kanchipuram District as per the registered Sale Deed dated 08.11.1991.
2. The learned counsel for the petitioner states that the application submitted by the petitioner to conduct survey in respect of the subject land has not been considered, despite the fact that the District Revenue Officer, Kanchipuram addressed a letter to the Assistant Director of Land Survey vide letter dated 28.03.2017. The learned counsel for the petitioner further states that the said order is to be enforced by the Competent Authority for the purpose of conducting survey of the subject land.
3. The learned Government Advocate, appearing on behalf of the respondents, made a submission that the application was submitted in the year 2017 and six years have lapsed. More-so, now the land is falling under the territorial jurisdiction of the Tahsildar, Sriperumbudur and the District Revenue Officer, Sriperumbudur.
4. Under those circumstances, the petitioner is at liberty to submit a fresh application along with the earlier application and the letter of the District Revenue Officer, Kanchipuram, within a period of two weeks from the date of receipt of a copy of this order.
5. On receipt of any such application from the petitioner, the first respondent-District Collector shall forward the same to the Jurisdictional Authority for the purpose of conducting survey, in the event of no objection or otherwise from any other person. The said exercise is directed to be completed by the first respondent, within a period of four weeks from the date of receipt of a copy of the application, if any, received from the petitioner.
