ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.353 of 2017 dated 21.11.2017 for the alleged offence under Section 379 of Indian Penal Code, 1860. The occurrence in this case happened on 18.11.2017. The complainant is present and submits that his two wheeler bearing Registration No. TN-23-BW-2412 Page No.1 of 3

has been returned to him. There is no previous or subsequent against the Accused and the case is pending at FS stage.

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in C.C.No.700040 of 2018 on the file of the Judicial Magistrate No.III Court, Tirupathur Taluk, Tirupathur stand quashed. This Suo Motu Transfer Case is disposed of.

23.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
