This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.S.S.Santhosa Kmuar, learned counsel for the appellant and Ms.Ramya V.Rao, learned counsel for the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The MCOP No.4325/2023 was filed by the legal heirs of the deceased Muthan who died in a road accident that took place on 12.06.2023 and the claimants had filed the petition claiming a compensation of Rs.15,00,000/- together with interest @ 7.5% p.a. The learned Judge, Motor Accidents Claims Tribunal, II Small Cause Court, Chennai, had awarded a sum of Rs.7,54,000/- together with interest @ 7.5% per annum. Challenging the said award, the present Civil Miscellaneous Appeal is filed by the appellant/Transport Corporation.

2. Now the claimants have agreed to receive a sum of Rs.8,00,000/- in full quit.

3. The Transport Corporation is directed to deposit the modified award amount in a period of six weeks from the date of receipt of a copy of this

order, less the amount already deposited if any.

4. On such deposit the first claimant is entitled to withdraw a sum of Rs.6,00,000/-. The claimants 2 to 5 are entitled to Rs.50,000/- each along with interest. Award is passed accordingly.

In the result, the Civil Miscellaneous Appeal is disposed of. The Managing Director, State Express Transport Corporation Ltd., Thiruvalluvar House, Pallavan Salai, No.2, Mount Road, Chennai - 2.
