The learned Central Government Standing Counsel appearing on behalf of the respondents 1 and 2 and the learned Government Advocate (Criminal Side) appearing on behalf of the 3rd respondent would submit that after enquiry, the authorities found that there is no criminal case pending against the writ petitioner. The information received was identified as mistaken fact. Thus, there is no impediment for considering the case of the petitioner for issuance of Passport.

2. In view of the above submission, the 2nd respondent / Regional Passport Officer is directed to consider the application submitted by the writ

petitioner and issue Passport by following the procedures as contemplated under the Act and Rules.

3. It is needless to state that the application is to be scrutinised with reference to the provisions of the Act and Rules.
