ORDER

The petitioner, who were arrested and remanded to judicial custody on 19.08.2025, for the offences punishable under Sections 7(1) and 20(1) of Cigarette and Other Tobacco Products Act, 2003 and Sections 275 and 123 of BNS in Crime No.337 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed as withdrawn by this Court, vide order dated 03.09.2025 in Crl.O.P.No.24184 of 2025.

The case of the prosecution is that while the respondent police were on their routine patrol duty, the petitioners colluded with other accused were found in illegal possession and transportation of 521 kilograms of banned tobacco products namely Hans, Cool Lip, Vimal Pan Masala and V-1 Tobacco. Hence, this case.

The learned counsel appearing for the petitioners submitted that the petitioner were falsely implicated, they were no way connected to the offence and they are in judicial custody since 19.08.2025. He further submitted that the petitioners are ready to abide by any conditions that may 2/4

be imposed by this Court and sought for bail to the petitioners. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that the petitioners colluded with other accused involved in illegal transportation, storage and distribution of huge quantities of banned tobacco products; that the petitioners have permanent address at Rajasthan; and that the investigation is pending. 5.

Considering the facts, gravity of offence, huge quantity of contraband involved in this case and the investigation is pending, this Court is not inclined to grant bail to the petitioners. 6.

Accordingly, this criminal original petition stands dismissed. 26.09.2025 stn 3/4
