Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to dispose of the representation of the petitioner dated 03-04-2023 on merits.

O R D E R

Aggrieved by the fact that patta had been wrongly issued to respondents 5 to 7 without notice to the petitioner, the petitioner made a representation to the 1st respondent to cancel the joint patta issued to the respondents 5 to 7. Thereafter, issue individual patta in her favour. After receipt of the said representation on 03.07.2024, the 1st respondent had issued show cause notice to the petitioner as well as respondents 2 to 7.

2. The petitioner participated in the hearing on 11.07.2024. However, respondents 2 to 7 had not attended enquiry. Once again the 1st respondent had issued notice for enquiry on 03.09.2024, which was attended by the petitioner and not by respondents 2 to 7. Despite the fact that the respondents have not attended the hearings, the last of which on 18.09.2024, the 1st respondent has not proceeded to pass order. Therefore, the petitioner is before this Court seeking a mandamus to the 1st respondent to dispose of the petitioner's representation dated 03.04.2023.

3. Heard the learned counsels on the either side and perused the records.

4. Considering the fact that the respondents 2 to 7 have not attended hearings on three occasions, the 1st respondent shall take note of all the documents presented before him and pass orders on merits, within a period of 8 weeks from the date of receipt of a copy of this 3/6

order.

5. The Writ Petition is allowed. No costs.
