KRISHNASAMY, Advocate for the petitioner and of MR.MOHEET RATHORE, Advocate for the Respondent the court made the following order:- [Order of the Court was made by M.M.SUNDRESH, J.] Though this appeal is preferred against the preliminary decree in a partition suit, it appears that the subsequent compromise entered between the parties did not fructify. Learned counsel appearing for the respondent submitted that the entire usufruct of the suit property is being enjoyed by the petitioner/appellant.

Both the counsels stated that they are ready for the disposal of the appeal.
Considering the submission made, the interim order granted on 10.11.2017 is made absolute and this miscellaneous petition is disposed of accordingly.
