Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to promote the petitioner as Block Development Officer or other equivalent post as per his service seniority based upon the representation given by the petitioner dated 09.06.2025 in the light of the order passed by this Hon'ble Court in W.P.No.13563 of 2022 dated 23.04.2024, W.A.No.583 of 2025 dated 04.03.2025 and Cont.P.No.39 of 2025 dated 09.06.2025 and the proceedings of the G.O.(2D).No.78 dated 03.06.2025, G.O.(2D).No.79 dated 06.06.2025 and Na.Ka.No.Pa.A2/3843/2022 dated 10.06.2025. ORDER
This Writ petition has been filed seeking to direct the respondents to promote the petitioner as Block Development Officer or other equivalent post as per his service seniority, by considering his representation dated 09.06.2025.
2. Mr.S.Yashwanth, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the 2/7
learned counsel on either side, this Writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that, he was appointed as a Junior Assistant on compassionate ground with effect from 15.02.2007. While so, as the regularisation of the petitioner's service was delayed by the respondents, he was deputed to undergo the training as mandated under Annexure-V of the Tamil Nadu Ministerial Service Rules, only from 05.02.2016 to 20.06.2016. However, as the petitioner was unable to attend the said training due to certain health ailments, he was once again deputed to attend the said training between 14.07.2017 and 16.08.2017 and he had also completed the same and was declared probation with effect from 17.08.2017. Though the petitioner had joined the services on 15.02.2007, his probation was declared only on 17.08.2017, after a lapse of about 10 years. Thereafter, the petitioner approached this Court by way of filing a writ petition, challenging the order passed by the 1st respondent dated 16.09.2019 and pursuant to the orders of this Court in W.P.No.13563 of 2022 and W.A.No.583 of 2025, the 1st respondent, vide G.O.(2D).No.79 dated 3/7
06.06.2025, declared the petitioner's probation with effect from 30.05.2010 and the petitioner has been granted service and monetary benefits including fixation of pay etc. In the mean time, the petitioner was promoted to the post of Deputy Block Development Officer on 01.07.2024 and the petitioner's service seniority was refixed by the Government orders and the consequential proceedings of the 3rd and 4th respondents. However, without considering the same, the 4th respondent promoted certain Deputy Block Development Officers as Block Development Officer. Aggrieved by the same, the petitioner made a representation dated 09.06.2025 before the respondents seeking to grant him promotion from the post of Deputy Block Development Officer to Block Development Officer. However, till date, no orders have been passed on the said representation. In such circumstances, the 4th respondent is considering one A.Latha for promotion to the post of Block Development Officer, whose seniority is below the petitioner's seniority. Hence, the petitioner has come up with this Writ petition.
4. Learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's 4/7
representation dated 09.06.2025 in the light of the orders passed by this Court in W.P.No.13563 of 2022 dated 23.04.2024, W.A.No.583 of 2025 dated 04.03.2025 and Cont.P.No.39 of 2025 dated 09.06.2025 and also in terms of G.O.(2D).No.78 dated 03.06.2025, G.O.(2D).No.79 dated 06.06.2025 and Na.Ka.No.Pa.A2/3843/2022 dated 10.06.2025 and consequently, promote the petitioner to the post of Block Development Officer or other equivalent post as per his service seniority.
5. Learned Additional Government Pleader appearing on behalf of the respondents submits that, appropriate orders will be passed on the petitioner's representation within the time stipulated by this Court.

In view of the above, this Court, without going into the merits of the case, directs the 4th respondent to consider the petitioner's representation dated 09.06.2025 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording opportunity of hearing to the petitioner and aggrieved persons, if any.
