ORDER
This Criminal Original Petition has been filed to call for records from the 1st respondent-Police in Crime No.468/2024 and to quash the same in so far as the petitioner (A-1) is concerned.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.
3. The allegation made in the F.I.R as against the petitioner is that the petitioner is the Scrap Vendor of the Godrej Company, Ambattur, Chennai. The petitioner was permitted to take scrap pursuant to the agreement entered into between the petitioner and the said company. The de-facto complainant is a Security Officer in the said Company. On 4.7.2024 and on also 08.7.2024, when the lorries bearing No.TN 12 AC 7710 and TN 20 AZ 4619 came to the company, some people assembled and threatened the driver of the lorries not to 2/5
come through the Gate No.1. Thereafter, on 12.7.2024 also similar incident had happened. Hence, the de-facto complainant lodged a complaint as against the accused persons.

On a perusal of the records, it is seen that the defacto complainant appears to be only an hear-say evidence with regard to the alleged occurrence Further, it is seen that no threatening act has been made by the petitioner and there is no specific overt-act attributed as against the petitioner. Hence, this Court is of the view that it will not lead to proving of offence. Hence, the continuance of the F.I.R is nothing but an abuse of process of law. This Court is inclined to quash the case in Crime No.468/2024 as against the petitioner.
5. In view of the above, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed. 17-09-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
