ORDER

By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2.This Writ Petition has been filed seeking for issuance of a Mandamus, to direct the respondents to give retrospective promotion to the petitioner herein with effect from the date of passing of Sanitary Health Inspector course on 01.06.1975 and sanction consequent monetary benefits to the petitioner, by considering the representation of the petitioner dated 21.01.2025.

3.Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the material available on record.

4.The case of the petitioner is that he joined the second respondent Office on 12.12.1964 as Multipurpose Health Assistant. He completed Sanitary Health Inspector Certificate Course during June 1975. The petitioner was promoted as Multipurpose Health Supervisor on 15.03.1989 instead of June 1975 and retired from service on 30.11.2003, upon attaining the age of superannuation. The second respondent has sent a proposal to the Government to implement the orders of this Court dated 13.07.2007 and furnished the list of the similarly placed persons, who are eligible for the promotion to the post of Health Inspector and the Government has also accepted the proposal and issued G.O.(Ms). No.278 dated 13.06.2019 stating that the Director of Public Health and Preventive Medicine is also permitted to pass suitable orders in favour of the eligible persons also, who have not filed Writ Petitions before this Court also, after receiving the representations with sufficient documents towards their

claims. The petitioner has approached this Court along with similarly placed persons to consider his case as per the orders passed in WP No.8375 of 2008 and etc. batch and this Court vide order dated 10.06.2011, directed the respondents to regularize them with effect from the date of their qualifying to the said posts. However, no action has been taken by the respondents to regularise his services and therefore, he has come before this Court by way of this Writ Petition.

5. Learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondents to consider the petitioner's representation and pass orders.

6. Learned Additional Government Pleader appearing for the respondents submitted that the representation of the petitioner will be considered within a time frame as stipulated by this Court.

7. In the light of the above, without going into the merits of the case, this Court is inclined to issue a direction to the second respondent to consider and

pass appropriate orders, on the petitioner's representation dated 21.01.2025, on its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.

8. With the above direction, this Writ Petition stands disposed of. No costs.
