ORDER

This Criminal Original Petition has been filed to call for the records relating to FIR in Cr.No.626/2024 on the file of the first respondent police and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the first respondent-Police and perused the materials available on record. 2/5

3. The petitioner has been charged for the offences under Sections 329(3), 61(2), 191(2), 319(2), 336(2), 336(3), 340(2), 324(4), 296(B), 118(1) and 351(3) of BNS. It is the contention of the petitioner that there is no specific overt act as against the petitioners.

4. On a perusal of the records, it is seen that the allegations as against the petitioners are forgery of document. This Court is of the view that merely on the ground that there is no specific allegation made as against the petitioner alone is not the ground to quash the F.I.R. In this case, Forensic report has also obtained and the entire aspect has to be investigated. In such view of the matter,, this Court is not inclined to quash the F.I.R at this stage.

5. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 22-09-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
