Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus directing the 2nd respondent to expedite the disposal of S.A.1/23 & S.A.16/23 within a stipulated timeframe, as any further delay would contradict the SARFAESI Act's purpose of facilitating swift and efficient recovery for secured creditors and legitimate purchasers. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Counsel states that matter has been pending for arguments for considerable period of time, when admittedly, the status quo order has already been vacated on 26.08.2024.
2. There will be so many other matters which are pending before the Debts Recovery Tribunal. There will be other applicant before the Debts Recovery Tribunal whose case is more urgent than petitioner. Therefore, we are not inclined to pass any order.
3. The writ petition is dismissed. Petitioner may, however, apply to the Debts Recovery Tribunal and the Debts Recovery Tribunal may consider the application and give a date as per its roster. We make no observation thereon.
