ORDER
The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondents 1 to 3 to take action against the 4th respondent to avoid breach of peace and tranquillity in the Nirmala Nilayam Retirement Community (Retirement Homes) at Theethipalayam, Coimbatore District by considering petitioners complaint petitions dated 24.03.2025 and 15.07.2025. 2.On instructions, the learned Government Advocate (Criminal Side) submitted that on receipt of the complaints from the petitioner, enquiry was conducted and closed.
3.However, the learned counsel for the petitioner submits that the petitioner developed the property by constructing 40 houses, in which the 4th respondent is also one of the purchasers. Thereafter , the 4th respondent occupied the common area which is meant for all the house owners and prevented the petitioner to provide the common amenities to the purchasers.
He further submits that the 4th respondent is a retired judicial officer. 4.In view of the above, the petitioner is hereby directed to lodge a fresh complaint on a fresh cause of action, if any. The 3rd respondent, on receipt of the complaint from the petitioner, is directed to deal with the complaint in accordance with law.
5.With the above direction, the Writ Petition stands disposed of. No costs. Consequently, the connected WPMP.Crl.No.375 of 2025 is closed. 02-06-2026 Index: Yes/No Speaking/Non-speaking order kas To
