O R D E R
The petitioners, who were arrested and remanded to judicial custody for the past 25 days, for the offence punishable under Sections 318(4) of BNS, 2023 and Sections 66C & 66D of the Information Technology Act, 2008, in Crime No.42 of 2025, registered on the file of the respondent, seeks bail.
2. The case of the prosecution is that the complainant is engaged in the business of garments under the name of Tygra Clothing. On 12.5.2025 while participating in a group relating to Ventura Securities Trading, the complainant on the instigation of one Suman Kumari, the petitioner joined the whatsapp group and in that group, the complainant received message stating that stocks were received at discount basis. From 15.05.2025 to 05.06.2025m the defacto complainant transferred amounts to various accounts on numerous transactions, as a result, the defacto complainant faced a financial loss to the tune of Rs.1,79,16,900/- for which the petitioners and other accused are responsible. Hence, the case.

Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and already a sum of Rs.14,50,000/- has been paid by the petitioners to the defacto complainant and they have been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioners.
4. Learned Government Advocate (Crl.side) appearing for the respondent police, while opposing for grant of bail to the petitioners, submitted that the petitioners are A8 and A9 and there is no specific allegation against them and reiterated that so far Rs.14,50,000/- has been
received by the defacto complainant.
5. Learned counsel for the intervenor/defacto complainant has acknowledged the receipt of Rs.14,50,000/- from the petitioners.
6. Heard both sides and perused the materials available on record.
7. Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, that part of the cheated amount viz., Rs.14,50,000/- has been received by the defacto complainant, considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned XI Metropolitan Magistrate, Saidapet and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the respondent
police everyday at 10.30 a.m., for a period of one week; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
