This clarification petition is filed bringing to the notice of this Court that, there was a typographical error crept in the order dated 30.03.2009 passed in W.P.No.42659 of 2006 in paragraph 6 & 7 of the said order.

According to the learned Government Advocate, instead of mentioning as 10 years of contingent service, due to typographical error it was mentioned as 5 years of contingent service and also brought to the notice of this Court that the petitioners have claimed the benefit of regularisation in terms of G.O.Ms.No.85 Education, Science and Technology Department dated 08.02.1994 which provides for regularisation of services on completion of 10 years of service but not 5 years. He also placed before this Court a copy of the order passed by the very same learned Judge on 03.04.2009 in W.P.No.39923 of 2006 wherein, the learned Judge passed very identical order and in the said order, the period of contingent service is mentioned as 10 years and not 5 years.

In the light of the above, this Court is thoroughly convinced that mentioning as 5 years of contingent service in paragraph 6 & 7 of the order dated 30.03.2009 in W.P.No.42659 of 2006 is only a typographical error and it should be 10 years of contingent service instead of 5 years of contingent service. Hence, 5 years of contingent service mentioned in paragraph 6 & 7 of the order dated 30.03.2009 shall be read as 10 years of contingent service. Accordingly, this miscellaneous petition is ordered.
