Petition seeking bail in respect of Crime No.264 of 2024 registered for the alleged offences punishable under Section 4(1-A) of the Tamil Nadu Prohibition Act is on board for consideration.

2. The incarceration of the petitioner being from 06.11.2024 pleading innocence on the part of the petitioner and false implication in the case, the learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner, aged about 60 years, has been implicated in this case, since she has some previous cases. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the accused was found to be in illegal possession of 15 bottles (each 180ml) of TASMAC liquor. He further submits that the petitioner is a habitual offender, against whom, 8 previous cases are pending, therefore, if the petitioner is released on bail, there is a possibility of her absconding and not available for further investigation.

4. At this juncture, the learned counsel for the petitioner submits that out of 8 previous cases registered against the petitioner, she was acquitted in four cases. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

5. Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the antecedents of the petitioner, this court is not inclined to grant bail to the petitioner.
