ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.08.2025 for the alleged offences under Sections 126(2), 296(b), 115(2), 324(2), 125, 311, 351(3) of BNS, in Crime No.478 of 2025, on the file of respondent police, seeks bail.

2. The case of the prosecution is that, the defacto complainant is running a tea stall, at the time, the petitioner and other accused persons demanded money from the defacto complainant and abused him with dire consequences and assaulted him and taken a sum of Rs.710/- from the case box of the defacto complainant. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been suffering incarceration from 03.08.2025. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the investigation is at preliminary stage.

Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking note to the gravity of offence, and submissions made by both counsels, the investigation is also at initial stage, and considering the antecedents, this court is not inclined to grant bail to the petitioner.
