ORDER
The Revision Petitioner herein is the wife, who has filed this Civil Revision Petition seeking a direction to dispose the petition in Crl.M.P.No. 370 of 2023 in D.V.O.P.No.22 of 2021 seeking for the relief of interim residence and also praying to restrain him from entering any portion of shared household.
2. Since the relief claimed by the Revision Petitioner only seeking a direction for a speedy disposal, the notice to the respondent is dispensed with.
3. Before the Magistrate court, the Revision Petitioner initiated deviation proceeding in D.V.O.P.No. 22 of 2021 against her husband and inlaws as she suffered harassment in their hands. She had also filed a petition in Crl.M.P.No. 370 of 2023 seeking for interim residence as well as interim injunction as she was dispossessed from the Plot, which was jointly purchased by herself and her husband out of her income. That application is pending before the Magistrate Court from the month of February 2023, in which the respondent has also filed his counter but so far there is no progress in the trial. Therefore, she wanted to direct the 2/4
Magistrate Court to dispose the case as early as possible.
4. Records perused. On perusal of entire facts, it reveals that the petitioner wife is living with a child without any proper residence shelter and the respondent also filed his counter, but so far there is no progress in trial. Therefore, this Court is inclined to direct the learned Magistrate to commence trial and dispose the case as expeditiously as possible within a period of two months from the date of receipt of copy of this order.
