(Order of the Court was made by the Hon'ble Chief Justice) Heard Ms.R.Thenamirtha Shyamala, learned counsel for the applicants, Mr.T.K.Saravanan, learned Government Advocate for non-applicants 1 to 4, Mr.S.Sathish Kumar, learned counsel for non-applicant 6 and Mr.N.Ponraj, learned counsel for non-applicant 5.

2. This application is filed to condone the delay of 188 days in filing the appeal.

3. Learned counsel appearing for non-applicants 5 and 6 oppose the application on the ground that no sufficient cause is mentioned. The application has been filed in a casual manner. The reasons do not come within the ambit of sufficient cause.

4. It is trite that whenever cause for substantial justice and technical considerations are pitted against each other, cause for substantial justice has to be subserved. The arguments on merits can be considered at the time of deciding the appeal.

5. For the reasons stated in the accompanying affidavit, the delay of 188 days in filing the appeal is condoned. Accordingly, the application stands allowed and is disposed of.

6. List the appeal for admission on 05.06.2024.

7. Print the names of Mr.S.Sathish Kumar, learned counsel for non-applicant 6 and Mr.N.Ponraj, learned counsel for non-applicant 5 at the time of admission.
