Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to pay difference in leave salary and difference in gratuity as per 14th wage settlement dated 24.08.2022 with 10% interest to the petitioners.

ORDER

By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself. Ms. S. Pavithra, learned Standing counsel takes notice on behalf of the respondents.

2. The relief sought for in this writ petition is a direction to pay the difference in leave salary and difference in gratuity as per 14th wage settlement dated 24.08.2022 with 10% interest to the petitioners.

3. It is stated by the petitioners that they joined service of the respondent Corporation as Technical Staff on 02.07.1984 and 16.08.1986 respectively. After rendering about 32 years of service, during the year 2022, they retired from service as Senior Tradesmen. It is the grievance of the petitioners that though terminal benefits due to them were settled by the respondents, the same were not settled properly by following the 14th wage settlement dated 24.08.2022. Ventilating their grievances i.e. claim with regard to difference in gratuity and leave salary, they submitted representations to the respondents on 17.06.2025 and 19.06.2025 respectively. They also sought interest of 10% for 2/5

the belated payments due to them. But till date, the respondents have not considered the said representations. Under such circumstances, this writ petition has been filed with the aforesaid prayer.

4. Learned counsel for the petitioners would submit that the petitioners are entitled to the wage difference in accordance with the 14th wage settlement along with interest. In this regard, the petitioners have given representations dated 17.06.2025 and 19.06.2025 respectively.

5. Learned Standing Counsel fairly submitted that the respondents Corporation will consider the representations of the petitioners and would settle the eligible amount to the petitioners along with 6% interest. Hence, this Court may issue appropriate directions in the above regard.

6. In view of the aforesaid submissions, without going into the merits of the case, this Court directs the respondents to pay the eligible and admissible amount with interest at the rate of 6% per annum for the belated payment of 3/5

terminal benefits, from the date of retirement till the date of actual disbursement to the petitioners, within a period of six weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition stands disposed of. No costs.
