This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the securities in the name of S.Ramesh, who died intestate died on 05.02.2023. The details of the securities had been given in the schedule to the petition.

2.The 1st petitioner is his wife and the 2nd and 3rd petitioners are his daughters and the 4th petitioner is his mother. The 2nd, 3rd and 4th petitioners had given their consent for grant of Succession Certificate to be issued in favour of the 1st petitioner.

3.After following due procedure, the petitioners were invited to tender evidence. Accordingly, the 1st petitioner examined herself as PW-1 and she marked Exs.P1 and P2, the Death Certificate and the Legal Heirship Certificate of her husband, S.Ramesh. She also filed Ex.P4, which is the accounts statement of the holds of her husband in HDFC Hybrid Equity Fund Growth.

smv 4.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the 1st petitioner in accordance with the rules.
