ORDER

Apprehending arrest in connection with Crime No.8 of 2024 registered for the offences punishable under Sections 120(b), 420 and 506(1) of IPC, the present petition has been filed seeking anticipatory bail.

2. The case of the prosecution is that the accused induced the defacto complainant on the assurance of getting a job and received a sum of Rs.14,36,000/- and cheated the defacto complainant. Hence the case.

3. The learned counsel for the petitioner would submit that he has received only a sum of Rs.5,00,000/- in his account and as per the direction of A6, the amount has been transferred to the account of A6. He would further submit that the petitioner is ready to appear for investigation.

4. The learned Government Advocate would submit that the petitioner along with the other accused cheated the defacto complainant to the tune of Rs.14,36,000/- on the guise of securing a job. He would further submit that Page No.2 of 4

the investigation is pending and there are materials to show that an amount of Rs.5,00,000/- has been transferred to the account of the petitioner.

5. The learned counsel for the intervener would submit that an amount of Rs.5,00,000/- has been transferred to the account of the petitioner on his directions. He would further submit that though a memo of calculation has been given, those transactions are pertaining to the period prior to the deposit of money by the petitioner.

6. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl. Side) for the respondent Police and the learned counsel appearing for the intervener.

7. Taking into consideration the facts and circumstances of the case and a sum of Rs.5,00,000/- has been transferred to the account of the petitioner and there is no proper explanation for the same, the anticipatory bail petition is dismissed.
