Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the second respondent police to provide adequate police protection to the petitioner and his property in Door No.46/354, Kandasamy Nagar, Narasingapuram Village, Attur Taluk, Salem District by disposing of the petitioner's complaint/representation dated 13.11.2024.

O R D E R

Mr.S.Sugendran, learned Additional Public Prosecutor accepts notice for respondents 1 and 2. Since no adverse order is being passed as against respondents 3 and 4, notice to those respondents is dispensed with.

This Writ Petition has been filed to seeking issuance of a writ of mandamus, to direct the second respondent/Police to provide adequate Police protection to the petitioner and his property, situated in Door No.46/354, Kandasamy Nagar, Narasingapuram Village, Attur Taluk, Salem District, by considering the petitioner's complaint/representation dated 13.11.2024.

According to the petitioner, the property situated in Door No.46/354, Kandasamy Nagar, Narasingapuram Village, Attur Taluk, Salem District, is petitioner's family property and he let out the said property to respondents 3 and 4 herein, during the year 2022. As the respondents 3 and 4 are irregular in payment of rents, the petitioner's 2/5

mother requested them to vacate the premises and they have also agreed to vacate the premises on or before 05.11.2024. While that being so, the third respondent visited the premises along with Goondas and rowdy elements, and hence the petitioner had given a Police complaint dated 13.11.2024 to the second respondent/Police seeking to provide adequate Police protection and the respondents/Police assigned CSR No.905 of 2024, but they did not take any action against the said complaint till date. Hence, the present writ petition has been filed by the petitioner.

4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials available on record.

5. It is seen from the records that there is a dispute between the petitioner/landlord and respondents 3 and 4/tenants, which is purely civil in nature. Therefore, this Court is not inclined to give any positive direction to the respondents 1 and 2 to investigate the matter and it is for the petitioner to work out his remedy before the competent Civil Court in the manner known to law.

6. In view of the above, this Writ Petition is dismissed. There shall be no order as to costs.
