ORDER
The petitioners, who were arrested and remanded to judicial custody on 04.02.2025 in S.C.Nos.64 and 65 of 2025 pending trial on the file of the I Additional District and Sessions Court at Ranipet, for the offences punishable under Sections 296(b), 109(1) and 49 of BNS and Sections 3 and 6 of Explosives Substances Act, 1903 and Section 4 of TNPPDL Act, 1992 in Crime Nos.34 and 35 of 2025, registered on the file of the respondent police, seek bail.

The case of the prosecution is that the defacto complainant lodged a complaint before the respondent police against one Tamilarasan for demanding money; that on account of the complaint, the respondent police had taken action and conducted enquiry; that due to which, the petitioners along with other accused got enraged over the investigation and action of the respondent police hurled petrol bomb into the police station and in front of the shop of the defacto complainant, with an intention to cause death to the defacto complainant and police officials; that thereby two cases were registered in Crime Nos.34 and 35 of 2025 against the petitioners and other accused.

The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they were falsely roped into these cases. He further submitted that the petitioners are not named accused in the FIR and the allegation in the FIR is only against one Tamilarasan and not against these petitioners. He further submitted that the investigation in this case was completed and final report also filed and the petitioners were in judicial custody since 04.02.2025 and the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent police while opposing the bail to the petitioners, reiterated the prosecution case and stated that CCTV footages regarding the occurrence is also available and the petitioners herein are habitual offenders. He also submitted that the investigation completed and charge sheet filed before the learned District Munsif and Judicial Magistrate, Ranipet District in P.R.C.No.9 of 2025 and the same was committed to the 3/4

stn learned Additional District Judge, Ranipet District in S.C.No.65 of 2025. and the charges are yet to be framed against the accused. 5.
Considering the facts, gravity of offence, serious nature of allegation against the petitioners and the stage of the case, this Court is not inclined to grant bail to the petitioners at the present. 6.
