Crl.MP.No.18387 of 2019 in HCP.No.2404 of 2019 Crl.MP.No.18387 of 2019 in HCP.No.2404 of 2019 R.SUBBIAH, J and R.PONGIAPPAN, J This Criminal Miscellaneous Petition has been filed by the sister of the detenu to direct the respondents to grant extension of ordinary leave for a period of 20 days from 10.12.2019 to 30.12.2019 to her brother Thepori Perumal, S/o.Govindasamy, Life Convict, Ct.No.19892 aged about 62 years now confined in the Central Prison, Vellore (Now on leave) in HCP.No.2404 of 2019.

2. The learned counsel for the petitioner submitted that this Court by order dated 19.11.2019 granted leave to the detenu from 26.11.2019 to 10.12.2019 and the same expires today. Since the mother of the detenu is in death bed, the learned counsel for the petitioner seeks extension of leave for another one week.

3. The learned Additional Public Prosecutor opposed for granting extension of leave.

Since already this Court granted leave to the convict from 26.11.2019 to 10.12.2019, this Court is not inclined to grant extension of ordinary leave for the detenu and accordingly, the detenu is directed to return to the prison by 5:00 p.m. today.
