2023-11-30Honourable Mr Justice S.S. Sundar,Honourable Mr Justice Sunder Mohan3 pages

in W.P.No.26953 of 2022 S.S. SUNDAR , J.

and SUNDER MOHAN, J.

[Order of the Court was made by S.S. SUNDAR, J.] This Writ Miscellaneous Petition is filed to extend the leave granted to the life convict, by this Court vide order dated 09.11.2023 in W.P.No.26953 of 2022, by a further period of 30 days from 01.12.2023 to 30.12.2023.

2.The petitioner is the wife of the detenu who is a life convict and detained at Central Prison, Vellore. Earlier, in the writ petition in W.P.No.26953 of 2022, this Court granted leave to the convict prisoner without escort for a period of 21 days from 11.11.2023. Now, the present petition has been filed by the same petitioner for extension of leave.

3.The detenu was granted leave, as the request was that the detenu's presence was required in connection with the ear boring

ceremony of the petitioner's child. Now, the extension of leave is sought for on the ground that the petitioner herself is suffering from anaemia and that she has breathing difficulty. The medical certificate produced before this Court shows that the petitioner is suffering from breathing problem due to anaemia. It is also stated that the petitioner underwent a surgery in 2020 and that she is now suffering from anaemia following the surgical procedure.

4.This Court does not find a proper cause for extension of leave. The petitioner's illness, even according to the petitioner, is anaemia. Anaemia is not a disease by itself, but it may be due to low haemoglobin levels, for which, the petitioner has to take medicines. Therefore, finding no merit in this petition, this Writ Miscellaneous Petition is dismissed. (S.S.S.R., J.) (S.M., J.) 30.11.2023 mkn
