Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, forbearing the respondents from layingthe road upon the Gramanatham land, situated in Survey No.90/1m Katchur Village, Seethancherri Post, Uthukkottai Taluk, Thiruvallur District, in the lawful possession and enjoyment of the petitioner.

O R D E R

The Writ Petition has been filed in the nature of a Mandamus restraint against the respondents from laying a road in a Gramanathan land, situated at Survey No.90/1, Katchur Village, Seethancherri Post, Uthukkottai Taluk, 2.A counter affidavit had been filed, wherein paragraph 11 had been stated as follows:

"11.I humbly submit that a road is laid from S.No.892 / 5

Katchur-Kalavai Village Road connecting to the school building in S.No.90/9. This road is running from S.No.89 and 909/9. It is learnt that it was primarily proposed by the village panchayat to lay road from S.No.89 through the Government Dry Anadeenam land is S.No.90/9 abutting the western side 90/1, 90/2, 90/3 and 90/4. However, the above proposal was not carried out. Hence this writ Petition does not survive at this stage".

3.It is thus seen that the proposal to lay a road abutting the western side of Survey Nos.90/1, 90/2, 90/3 and 90/4 has been dropped. Recording the same, the Writ Petition stands disposed of. The respondents have every right to revive the proposal if there is necessity to do so. No costs. Consequently, connected miscellaneous petitions are closed.
