(Order of the court was made by S.M.SUBRAMANIAM, J.) This miscellaneous petition has been filed to condone the delay of 40 days in filing the above appeal suit.

Mr.R.N.Amarnath, the learned Counsel for the respondent would oppose by stating that the appeal suit itself is not maintainable.

However, the said grounds are to be adjudicated during the course of hearing of the appeal. Therefore, in view of the reasons stated in the accompanying affidavit filed in support of the petition, delay is condoned and this miscellaneous petition stands ordered.
