ORDER

The petitioner seeks for a direction to transfer the investigation for conducting fresh enquiry.

2. The petitioner is the defacto complainant had lodged a complaint on 1.02.2022 for the alleged theft of 11 sovereigns gold jewels and 600 grams of silver articles and the respondent police has registered FIR in Cr.No.49 of 2022 for the offences under Sections 454 & 380 of IPC. According to the petitioner, though the FIR has been registered in the year 2022, the same has not been investigated properly. Whereas, the learned Government Advocate (Crl.Side) submitted that accused could not be identified; more than 12 suspect persons' finger prints were sent for examination, however, they were not matching the evidence collected in the crime scene. Therefore, the FIR has been closed.

3. Heard both sides and perused the materials placed on record.

4. Let the respondents continue to monitor and if any finger print matches with the crime, the respondent police shall re-open the case and file a final report. Therefore, at this stage, this Court is of the view that 2/4

transfer is not required.
