The Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate No.I, Krishnagiri District, to expedite the proceedings in P.R.C.No.05 of 2016 and commit the same within a time frame.

The contention of the learned counsel appearing for the petitioner is that based on the complaint lodged by the de facto complainant, a case in Crime No.10 of 2011 was registered by the respondent for the offence under Sections 323, 324, 294(b) of IPC and Section 3(1) of TN PPDL Act. After completion of investigation, a charge sheet was filed and the same is pending committal in P.R.C.No.05 of 2016 on the file of the Judicial Magistrate No.I, Krishnagiri. However, despite the lapse of time, there has been no progress. Hence, the present petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

4. Considering the facts and circumstances of the case particularly that the case pertains to the year 2011 and despite the filing of the charge sheet in the year 2016, the case is still pending committal, this Court directs the learned Judicial Magistrate No.I, Krishnagiri, to commit the case in P.R.C.No.05 of 2016 to the Court of Sessions as expeditiously as possible. 2/4
