In continuation and conjunction to the earlier order passed by this Court on 02.02.2024, the learned Public Prosecutor has filed a counter, in which, in paragraph nos.10 and 11, it is admitted that the iron scraps and cash of Rs.1,49,500/- belongs to the petitioner and that further investigation in this case is completed and charge sheet too has been filed in CC.No.77 of 2023.

2.In view of the above, the petitioner is entitled to the seized amount of Rs.1,49,500/-, which is deposited to the credit of Crime No.329 of 2022 before the trial Court and the trial Court to handover the cash to the petitioner after taking photographs of the cash, recorded by a Mahazar attested by the petitioner, in the presence of the Magistrate with an affidavit that this interim custody of money is subject to the outcome of the trial and to obtain a bond for a sum of Rs.1,49,500/-. 1/3
