O R D E R

The Criminal Original Petition has been filed seeking to quash the impugned FIR in Crime No.8 of 2025 on the file of the Inspector of Police, District Crime Branch, Krishnagiri District The learned counsel for the petitioner submitted that the petitioner, who is a Sub-Registrar at Krishnagiri Registration District, registered a Power of Attorney bearing Document No.90 of 2025 dated 05.05.2025 in Book 4 relating to land in Survey No.544, Avalapalli Village, within the jurisdiction of the Sub-Registrar Office, Hosur. The said Power of Attorney was executed only for the limited purpose of updating patta and revenue records and not for any conveyance or transfer of title. The document was later voluntarily cancelled by the parties themselves.

3. The allegation against the petitioner is that, in collusion with other parties, he registered a power of attorney relating to government land, based on a complaint given by the District Registrar within four days of the registration.

5. This Court is aware of the fact that it is well settled that a SubRegistrar is not bound to verify the title of the property presented for registration. His duty is limited to verifying the identity of the parties, the execution of the document, and compliance with registration formalities. Hence, the mere act of registering a document, without verifying the title, cannot by itself constitute an offence or imply collusion unless there is specific material to show the Sub-Registrar's active participation in the alleged illegal act.

6. This Court is also aware of the fact that when Government properties are dealt with by a Sub-Registrar, he must be very vigilant though the act may not attract the other offences. Since there are allegations against the other accused persons, which needs to be investigated properly, at this stage, this Court is not inclined to quash the FIR and accordingly, this Criminal Original Petition stands dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 08.10.2025 kak To 3/5
