This application has been filed seeking leave to sue the respondent under Clause 12 of the Letters Patent.

2.The respondent is having its office at New Delhi. The suit has been filed for infringement of design and passing off.

3.As seen from the plaint averments and from the affidavit filed in support of this application, the applicant has stated that the respondent has committed infringement at Chennai.

4.Since a part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to sue as prayed for.
