Heard Mr. Ali Hassan Khan, Learned Counsel for the Petitioner and Mr. S.J.Mohamed Sathik, Learned Government Pleader, who takes notice for 1/4

the Respondent, and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed challenging Proceedings in Notice No.2/ 2023/F1 dated 19.06.2023 issued by the Respondent directing to obtain approved plan for construction from the competent authority and intimate the same within seven days from the date of its receipt. 3.

Learned Counsel appearing for the Petitioner submits that having regard to the powers conferred under Section 56(3) of the Tamil Nadu Town and Country Planning Act, 1971, to grant planning permission, the Petitioner would make an application under that legal provision and seeks permission of the Court to withdraw the Writ Petition and he has made an endorsement to that effect in the Court record.

In view of the same, the Writ Petition is dismissed as withdrawn. Consequently, the connected Miscellaneous Petitions are closed. No costs. 21.12.2023 Index: Yes/No NCC: Yes/No Note: Issue order copy by 22.04.2024.
