This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 11.03.2024, seeking bail in Crime No.200 of 2024, registered for the offence punishable under Sections 8(c), 22(c), 29(1) of NDPS Act, 1985.
2. The case of the prosecution is that on 11.03.2024, on receipt of a secret information regarding illegal transportation of narcotic substance, the Respondent along with his team, had gone to the Bharathi nagar housing board backside, R.K.Nagar, Chennai, wherein, they found that the petitioner along with other accused persons was in illegal possession of Methamphetamine, weighing 60 grams. Hence the case.
3. Learned counsel appearing for the petitioner submitted that this is the second bail petition filed by the petitioner. He further submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He has not committed any offence as alleged in the FIR. He
further submitted that the co-accused was released on bail. He further submitted that the petitioner is in custody from 11.03.2024 and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are 2 accused in this case and the petitioner herein is arrayed as A1. He further submitted that when the respondent police received a secret information about the illegal possession of narcotic substances, they went to the scene of occurrence, wherein they found the petitioner along with other accused is in possession of Methamphetamine, worth about Rs.1,20,000/-, which is a commercial quantity and the same was seized from the petitioner.
He further submitted that during investigation, it was revealed that the accused person/A1 purchased the contraband from Andhra Pradesh and this petitioner/A2 given money to A1 to sell in and around local area of Chennai, for their personal gain.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and also perused the materials available on record.

Considering the representation made by both side counsel, grave nature of offence and the quantity of contraband involved is a commercial quantity, and the petitioner has 20 previous cases pending against him, and investigation is also not yet completed, it is not appropriate to consider the bail application of the petitioner at this stage.
