The present Application has been filed to grant leave to sue the respondents/defendants before this Hon'ble Court in the above suit.

2. In spite of seeking time to file counter, there is no representation on behalf of the first respondent today. Even though the learned counsel for the second respondent seeks time to file counter, the second respondent is only a formal party, who would only be responsible to comply with the order, if the order is passed against the first respondent.

3. Considering the averments made in the affidavit filed in support of this application and having satisfied with the same, the application in A.No.490 of 2025 in CS DR.No.155089 of 2024 is ordered as prayed for.
