Apprehending arrest in connection with Crime No.15 of 2024 registered for the offences punishable under Sections 468, 471, 420 of IPC, the present petition has been filed seeking anticipatory bail.

2. The case of the prosecution is that the first accused, who was working as a temporary computer operator in Villupuram Municipality, by falsification and fabrication of documents has misappropriated Government funds to the tune of Rs.8,01,38,245/-. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he was employed by the first accused and he has acted as per the instructions of the first accused. He would submit that, till 2022 the petitioner was a student and that he has nothing to do with the alleged offence. Hence, he seeks for anticipatory bail. 4.The learned Government Advocate has filed the counter statement of the respondent police and submitted that the first accused was working as a Page No.2 of 4

temporary computer operator in Villupuram Municipality and that by falsification and fabrication of documents, he has misappropriated Government funds to the tune of Rs.8,01,38,245/-. He would further submit that as far as the petitioner is concerned, to his account an amount of Rs.1,48,31,621/- has been transferred and the amounts are yet to be recovered. This is a case of embezzlement of public fund and an amount of Rs. 1,48,31,621/- has been transferred to the petitioner's account and the money has been withdrawn and spent and therefore, custodial interrogation of the petitioner is very much required for further investigation.

Taking into consideration the fact that public funds to the tune of Rs.8,01,38,245/- has been embezzled and an amount of Rs.1,48,31,621/- has been transferred to the account of the petitioner and the custodial interrogation of the petitioner is required, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
