Apprehending arrest in connection with Crime No.151 of 2024 registered for the offences punishable under Sections 306 and 3(5) of BNS, the present petition has been filed seeking anticipatory bail. 2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3.The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner along with other accused was working in Vault Team of CMS Infosystem Limited and they have committed misappropriation of Rs.1 crore of consumer cash. After receiving the complaint from a consumer of ICICI Bank, the CCTV footage of ICICI Page No.1 of 3

Bank ATM was verified and the accounts were audited. After investigation, the petitioner had admitted the offence along with other accused in connivance. He also submits that the present petition for anticipatory bail has been filed suppressing the earlier dismissal of anticipatory bail in Crl.O.P.No.27616 of 2024 on 07.11.2024.

4.Mr.B.Prashanth Nadaraj, learned counsel for the Intervenor/Defacto complainant would submit that the petitioner has already filed a petition for anticipatory bail in Crl.O.P.No.27616 of 2024 and the same was dismissed on 07.11.2024 and there is no change in circumstances. 5.Taking into consideration the fact that the petitioner has suppressed the earlier dismissal of the anticipatory bail in Crl.O.P.No.27616 of 2024 on 07.11.2024 and there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
