Respondents Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned orders in Na.Ka.No.8448/2019.TCP 7 dated 24.10.2019 on the file of the 2nd respondent and the order in Na.Ka.No.1067/2017/Thi.Va.Ma.2 dated 11.11.2019 on the file of the 6th respondent quash the same and direct the respondents to delete the proposed A3 100 feet road in the petitioner's land in S.No.436/1, 2 of Thiruvallur Village, Thiruvallur Municipality as per the recommendation of the Local Planning Authority viz., the 5th respondent. ORDER
This learned counsel appearing for the petitioner seeks permission of this Court to withdraw the writ petition and he has also made an endorsement to that effect in the court bundle.
2. In view of the submission and endorsement made by the learned counsel appearing for the petitioner, this Writ Petition is dismissed as withdrawn with a liberty to the petitioner to file a fresh writ petition seeking relief under Section 38 of the Tamil Nadu Town and Country Planning Act, 1971. Consequently, connected Miscellaneous Petition is closed. No costs.
