ORDER

This Writ Petition has been filed against the order dated 21.04.2017, wherein, the pension of the petitioner has been refixed by the respondents and for recovery of excess payment made towards the pension to the petitioner.

2. A counter affidavit has been filed on behalf of the respondents.

3. When this case was taken up for hearing, the learned counsel for the petitioner submits that during the pendency of this Writ Petition, the respondent restored the pension to the original position and the same is being paid to the petitioner till now and as such no further adjudication is required at present in this Writ Petition.

4. The learned counsel for the petitioner sought permission of this Court to challengeany order to be passed by the respondents for refixation of pension or for recovery, in future.

5. In view of the factual position, in our considered view, as Page No: 2/4

already the pension of the petitioner is restored, no further adjudication is required in this case at present.

6. Accordingly, this Writ Petition is dismissed as infructuous. However, it is made clear that the petitioner is at liberty to challenge, if any order be passed in future by the respondents against the petitioner for refixation of the pension or for recovery.

7. There shall be no order as to costs.
