ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.08.2025, for the offences punishable under Sections 24(1) of Cigarette and other Tobacco Products Act 2003 (COTPA Act) r/w 123,275 of BNS in Crime No.173 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner and other accused were in possession of 182.092 grams of banned tobacco products Rs.1,36,240/- . Hence, this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been arrested only based on the confession of the coaccused. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there are two previous cases pending 2/4

against the petitioner. He further submitted that investigation in this case is not yet completed.

5. Considering the facts of the case and the nature of offence committed by the petitioner and the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
