The petitioner is an accused in C.C.No.1347 of 2023, now pending before the Judicial Magistrate No.III, Coimbatore, seeks bail. Originally, Crime No.181 of 2023 had been registered for the offence under Section 379 r/w 109 IPC.

2.The learned counsel for the petitioner states that the petitioner has been in custody from 13.04.2023 for more than seven months but it is stated that trial is in progress and there are also ten previous cases against the petitioner herein.

3.Let me not enter into a discussion on merits since the evidence is being recorded by the learned Judicial Magistrate. It is stated that eight witnesses had already been examined and there are only six more witnesses have to be examined. The learned Judicial Magistrate may apply mind and endeavour to record the deposition of the witnesses, provided the learned counsel for the accused co-operates and dispose of the case on or before 31.01.2023.
