ORDER

Mrs.S.Mythreye Chandru, learned Special Government Pleader accepts notice on behalf of the Respondents 1 to 4 and Mr.T.Ravikumar, learned Standing Counsel accepts notice on behalf of the fifth respondent. With consent of the learned counsel on either side, this writ petition is taken up for final disposal.

2. This Writ Petition has been filed seeking a direction to the respondents to release the retirement benefits of the petitioner from the date of retirement.

The case of the petitioner is that she is a retired BT Assistant, who, prior to her retirement, received a legal notice from one Mr.Jahir Basha, alleging that she had availed a personal loan from him and had issued a postdated cheque which was subsequently dishonoured due to insufficient funds. Subsequently, proceedings under section 138 of the Negotiable Instruments Act were initiated against her before the Judicial Magistrate Court, Dharmapuri. During the pendency of the said case, the retirement benefits of the petitioner were not disbursed. Therefore, the petitioner submitted a representation dated 23.08.2025 to the second respondent seeking release of her retirement benefits. However, the same was ignored by the first respondent. Hence, the present petition has been filed for the aforesaid relief.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 4 and the learned Standing Counsel for the fifth respondent.

5. Though several grounds have been raised by the petitioner, this Court finds it appropriate to issue a direction, without going into the merits of 3/6

the case, to the fourth respondent to consider the representation of the petitioner dated 23.08.2025 and pass orders, on its own merits, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not made any observation with regard to the merits of the petitioner's claim.

6. With the above direction, this Writ Petition is disposed of. No costs.
