O R D E R

Since the petitioner has been dismissed from service under Rule 17 (c) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955 on account of his conviction under the Prevention of Corruption Act, though it is stated that the aforesaid conviction is under challenge in a pending criminal appeal, this Court is of the view that merely on account of pendency of criminal appeal, the petitioner cannot seek for continuation of service or to restrain the respondents from taking any disciplinary action against him.

2. As the dismissal of the petitioner from service is on account of his conviction and the disciplinary proceedings having been initiated under Section 17 (c) of the Rules, 1955, the said dismissal would abide by the result of the criminal appeal.

3. For the said reason, the present writ petition need not be kept pending. 2/4
