ORDER
This civil revision petition has been filed seeking direction to the learned Principal District Judge, Chengalpattu to dispose of the suit in O.S.No.304 of 2015, within the stipulated period, fixed by this court.
2. The petitioner/plaintiff herein filed the above said suit for recovery of
money against the respondents/defendants, based on thSe loan transaction. It is seen from the remarks submitted by the learned Principal District Judge, Chengalpattu that the defendants 3 to 6 were set exparte on 13.06.2018 for their failure to file written statement. Thereafter, the said exparte order was set aside on 17.11.2021 at the instance of the petition filed by the defendants 3 to 6 and issues were framed on 15.12.2021 and PW1 was examined in chief on 07.11.2022. Subsequently, the case was adjourned from time to time periodically for cross examination of PW1. Again, defendants 2 to 5 were set exparte on 07.08.2023 and the matter was posted for pronounding judgment on 28.08.2023. Subsequently, the case was reopened for clarification on 09.10.2023.
A petition under Order IX Rule 7 CPC was filed to set aside the exparte order and the same was allowed on condition to deposit a sum of Rs.4,00,000/- in court on or before 08.08.2024 and the case was posted for reporting compliance on 09.08.2024. However, on that day, there was no representation.
filed by the defendants 2 to 5 were dismissed and the case was posted for pronouncing judgment on 06.09.2024. Again, on 30.09.2024, the case was reopened for clarification regarding limitation. Inspite of sufficient opportunities given, the petitioner/plaintiff failed to appear before the court for clarification till 29.10.2025. On 29.10.2025, the petitioner/plaintiff was called absent and hence the suit was posted for perusal of records and passing orders by 05.12.2025. 3 . he learned Judge, in his remarks, assured that the suit will be disposed of within two months.
4 . Taking into consideration the fact that the petitioner was absent before the Trial Court, when the matter was posted for clarification and also the
fact that the suit is in the advance stage of pronoucing judgment, this court is inclined to direct the Trial Court to dispose of the suit in O.S.No.304 of 2015, within two months, from the date of receipt of copy of the order. 5 . With the above direction, this civil revision petition is allowed. There shall be no order as to costs.
